Room use and approvals

Queensland habitable rooms.

Understand why a bedroom, living area or converted space must be assessed by its approved use and supporting documentation—not its furniture or presentation.

Buyer overview

A furnished room is not necessarily an approved habitable room.

The National Construction Code distinguishes habitable and non-habitable rooms. Relevant provisions can include room height, light, ventilation, weatherproofing, fire safety, access and other construction requirements. The requirements applying to particular work depend on its approval date, building classification and circumstances.

01

Approved use

Council and certifier records can help establish whether the space was approved for its current use.

02

Physical attributes

Ceiling height, openings, ventilation, moisture, access and construction may provide visible indicators but do not establish compliance.

03

Converted spaces

Garages, enclosed patios, undercroft areas and sheds commonly require further checks before being relied on as accommodation.

Inspection scope: The inspection records observable conditions in reasonably accessible areas. It does not determine the lawful use of a room, conduct a building approval search or certify NCC compliance.
Practical checks

What buyers should observe and verify.

Indicators requiring attention

  • A bedroom or living area within a former garage, patio, veranda, subfloor or shed.
  • Low or sloping ceilings, bulkheads or reduced head clearance.
  • No apparent external window, limited natural light or limited ventilation.
  • Dampness, mould, efflorescence or finishes below surrounding ground level.
  • No apparent smoke alarm, unsuitable escape pathway or restricted access.
  • Recent partitions, bathrooms or kitchens without available approval records.

Recommended document checks

  • Obtain the approved plans, decision notice and final certification from the seller or relevant council.
  • Confirm the approved room description and building classification with a building certifier.
  • Ask a solicitor or conveyancer whether the represented use should be addressed before settlement.
  • Arrange specialist moisture, ventilation, fire safety or structural assessment where visible evidence warrants it.
  • Do not value or rely on a room as a bedroom until its approved use is satisfactorily established.
Limits of a visual inspection

Approval and compliance cannot be determined visually.

A visual inspection may identify features that warrant concern, but it does not establish which technical provisions applied when the work was undertaken or whether approvals were obtained.

Not confirmed

  • Lawful or approved room use.
  • Compliance with NCC room height, light, ventilation, fire safety or energy-efficiency provisions.
  • Concealed damp-proofing, insulation, framing or waterproofing.
  • Property valuation, rentable-room status or insurance acceptance.
  • Future suitability of the room for a proposed use.

When specialist input is appropriate

  • Building certifier for approval status and applicable building provisions.
  • Local council for archived building and plumbing records.
  • Solicitor or conveyancer for contractual and disclosure advice.
  • Engineer or other relevant specialist where structural or moisture evidence is present.
Room dimensions may be recorded where relevant, but a measurement alone is not a compliance assessment. Written approval and certification records should be checked.
Official information

Authoritative sources and further reading.

Requirements can change and may depend on the building classification, approval date and work undertaken. Confirm current obligations with the relevant authority or appropriately licensed specialist.

Common questions

Frequently asked questions.

Can an inspector confirm that a room is a legal bedroom?

No. The inspection may report visible indicators and recommend records checks, but approved use must be established from appropriate approval and certification evidence.

Does a window make a room habitable?

Not by itself. Multiple provisions may apply, and the relevant requirements depend on the building and approval circumstances.

What should I do if a garage is advertised as a bedroom?

Request approved plans and final certification, then obtain advice from a building certifier and your solicitor or conveyancer before relying on that use.
